Supreme court insists that rebellion was evident
The Supreme Court maintains its insistence before the German judiciary that Carles Puigdemont is responsible for rebellion and misuse of public funds. This was made evident in the final report that the Spanish Supreme Court sent the to Schleswig-Holstein court on the October 1 referendum. Initially, the German judges dismissed the possibility of extradition for rebellion for lack of violence, but requested further information regarding the possible misuse of public funds before it decides on the European extradition warrant against the 130th president of the Generalitat.
The report, published yesterday by newspaper La Vanguardia reiterates the crime of rebellion and emphasises the involvement of the exiled president “was paramount because he was the person who, as his position corresponds, had full responsibility for the course and the direction of events.” The Spanish court also asks the Schleswig-Holstein judges to refrain from going into the substance of the matter or seeking similarities between Spanish and German Criminal Code, “but simply consider whether the facts would lead to criminal charges in Germany.” It also asks the judges to take into account previous instances of “repeated disobedience of resolutions by the Constitutional Court. “
